The Rose.it trademark is owned by the company Rifnet SRL which has entrusted the sale of roses to the company Roseland Società Agricola S.S. through the website www.rose.it.
The company that cultivates, handles the shipment, receipt and invoicing of the goods is Roseland Società Agricola S.S. , Via Marcador n.165, 32026 Borgo Valbelluna (BL) VAT n. 01247670258
In these general sales conditions:
"Customer" means any person who purchases one or more products through the Site.
"Site" means the website www.rose.it.
By "Rose.it" we mean the company Rifnet srl, owner of the brand, and the company Roseland that deals with the shipment, receipt and invoicing of the products.
Seller part and applicable legislation to this sales contract
Roseland will act as a seller of all the products and services that the Customer chooses to purchase through the Site and to receive at home. The purchase and sale of products and the provision of services purchased through the Site is governed by these general conditions as well as, insofar as applicable, by the provisions of the Consumer Code and of Legislative Decree no. 70/2003 and the provisions of the civil code, for what is not provided here.
The Rifnet SRL company owns the Rose.it trademark but does not take care of the sales and shipping of the goods.
Art. 3 Positive result of the verification of availability and conclusion of the contract
The offer of products that can be purchased through the Site constitutes an invitation to offer and the order sent by the Customer through the Website will be considered a contractual purchase proposal, subject to confirmation and / or acceptance by Rose.it as described below.
The characteristics of the products and services offered on the Site are described in the specific information sheets published on the Site. We invite you to read them carefully and understand that certain products, even if present on the Site, may not always or immediately be available.
The information sheet for each product clearly indicates whether the product you have selected is:
- "available": means that the product is physically present in the central warehouse of Roseland.
In this case the Customer can immediately proceed with the purchase of the relative product by sending the purchase proposal, according to the methods indicated on the Site.
In the case of "available" products, the Customer's purchase proposal will be considered immediately accepted by Rose.it. Therefore, the e-mail confirmation of receipt will be worth as well as confirmation of acceptance. Rose.it will proceed directly to the shipment of the products purchased by the Customer within the times and in the ways indicated in these general conditions.
Rose.it undertakes to do everything possible for the satisfaction of its Customers and for a swift and efficient handling of orders sent through the Site. However, it may exceptionally happen that a product indicated as "available" and for which the Customer has made the payment at the time the order is placed, is no longer available at the time of the acceptance of the purchase proposal by Rose.it. In this case, Rose.it will immediately notify the Customer via e-mail, with whom it will agree on the method of return or change of the order.
Art.4 "Purchase procedure"
The Customer undertakes, before proceeding with the confirmation of his Order, to read these Conditions and to accept them by means of a check (flag) in the box indicated.
The Seller offers for sale its products within the limits of stock available at the time of the purchase order. Orders may be subject to quantity restrictions, minimum or maximum.
and technical steps to make an Order are clearly highlighted in the sequence of pages of the Site, through explanatory texts and graphics.
By clicking on "Order Confirmation", the Customer will make a contractual offer to Roseland regarding the items contained in the Basket.
To complete the Order, the following formalities must be completed:
a) reading and acceptance of the Customer, through "point and click", of these Conditions;
b) electronic compilation by the Customer - by inserting all the required data - of the Order Form, which contains a summary of the essential characteristics of each product or service chosen and its price; the means of payment for which the Customer has opted; the methods of delivery of the purchased products; the times and costs of shipping and delivery; the conditions for the exercise of the Customer’s right of withdrawal and for the application of the legal guarantee of compliance; the methods and times for returning purchased products;
c) payment to the Seller of the price of the product/s purchased by the Customer, including shipping and delivery costs;
d) automated electronic forwarding to the Seller of the aforementioned Order Form;
e) Electronic receipt by the Seller of the above-mentioned Order Form
Art. 5 "Prices and payment methods"
The prices of the products offered on the Site include VAT, while they do not include any transport costs and / or other additional services that may be required by the Customer.
The price of the services and products shown on the Website in the relevant technical data sheets is the one in effect at the time of the sending of the purchase proposal by the Customer, as viewable by the Customer on the Site at the time of product selection and within the proposal itself.
Without prejudice to the aforementioned, Rose.it reserves the right to modify at any time, at its sole discretion and without notice, the price of the products and services from time to time present on the Site, without therefore providing any guarantee with respect to whether the sale price of the products or services remains available on the Site or unchanged for a certain period of time.
The technical data sheets of the products on the Site, containing the description of the functions and characteristics of each product, are drawn up directly by the manufacturer of each product concerned.
The images and photos used to accompany each product description sheet are merely indicative and may not be perfectly representative of the characteristics of the product itself, as this may differ in size, the vegetative state of the plant compared to the photos used.
The order summary will be included in the shipment, which also serves as a receipt.
The invoice for the products (and related services) purchased through the Site will be issued at the time of shipment and will be included in the shipment and a copy will be sent to the Customer's e-mail address.
For orders concerning multiple products, separate invoices can be issued based on the shipments made.
5.2 Accepted payment methods
The products purchased by the Customer through the Site can be paid alternatively, with:
a. Credit card,
c. Bank Transfer,
d. Cash on delivery (only for the Italian territory).
In the event that the payment method chosen by the Customer is debited to the credit card, at the time the order is concluded there will be no charge, but only the issuing of an authorization for the amount necessary for the purchase. The actual charge will only be made at the time of shipment of the product (s).
At no time during the payment procedure, Rose.it is able to know the information relating to the credit card, credit card number or financial, asset and personal information of the customer. The payment order is, in fact, transmitted - through a protected connection - directly to the portal of the bank or financial company expressly indicated, at the time of confirmation by the Customer.
Rose.it is in no case responsible and cannot be held responsible for any fraudulent or illegal use of credit cards that can be made by third parties during the purchase and payment of products.
Rose.it reserves the right not to accept a purchase proposal or to suspend the execution of proposals already confirmed in the event of anomalies or irregularities in payment. In this case, Rose.it reserves the right to ask the customer for additional information and / or to send copies of documents proving the ownership of the credit card used for the purchase. In the absence of the required documentation, Rose.it reserves the right not to accept the purchase proposal or to terminate any contract already concluded, without this giving any right to the Customer to request compensation for damages or to assert other claims.
If the Customer has chosen to purchase through the PayPal payment method, at the end of the order the Customer will be directed to the PayPal login page and the payment will be managed according to the rules governing the account held by the Customer directly with PayPal. In this case, therefore, the amount for the purchase of the product will be charged immediately upon sending the order by the Customer according to the conditions applied by PayPal itself.
If the customer has chosen to purchase through the payment transfer method, at the end of the order the customer will receive the email with the bank details where to send the payment.
ATTENTION: The order will be processed only after receiving the payment (it takes from 1 to 3 days from the execution).
Payment on delivery
If the Customer has chosen to purchase through the payment method with cash on delivery, at the end of the order the Customer will receive the confirmation e-mail with the exact amount to be delivered to the courier (bank checks are not accepted).
Art.6 "Product Delivery"
Place of delivery
Rose.it will deliver the products to the address indicated by the Customer in the purchase order. The goods are delivered on the roadside, at the street number (not inside the house). Delivery is always preceded by notice.
Delivery times and stock
The Products indicated as "available" will be delivered within the deadline indicated in the relevant product sheet and / or in the e-mail confirming acceptance of the purchase proposal, and in any case no later than 10 (ten) working days from the dispatch of the e-mail confirming acceptance of the purchase proposal.
Rose.it carries out the shipment of roses from Monday to Wednesday, with the intention of avoiding that the rose plants purchased can remain for too long at the courier before delivery to the end customer.
Therefore it is useful to know that orders placed on Thursday or Friday will be entrusted to the courier for delivery on Monday, so as to guarantee you healthy and not suffering plants.
The actual delivery times also depend on where you are.

Art 7. "Transfer of risks and transport damage"
Verification of the products by the Customer
The customer is required to verify, upon arrival of the ordered products:
a. if the number of packages delivered corresponds to that indicated on the transport document;
b. if the packaging is intact;
c. if the delivered product complies with its purchase order.
The customer must sign the delivery note indicating "subject to control over product integrity"; if this does not happen, the customer cannot subsequently contest the external non-conformity of the Product and its quantity with respect to what was ordered.
Art.8 Right of Withdrawal
Pursuant to Articles 52 et seq. of the Consumer Code, the Consumer Customer has the right to withdraw from the Contract within the term of 14 (fourteen) days from receipt of the product at his home without any penalty and without having to provide any reasons.

The Consumer Customer must communicate his intention to withdraw from the contract in one of the following ways:
a. by e-mail to email@example.com;
b. by calling +39 3519731168 from Mon to Fri 9-12, 15-18
Rose.it will confirm to the Consumer Customer without delay, via e-mail to the e-mail address communicated during the purchase procedure on the Site, the receipt of the exercised withdrawal declaration and will provide the Customer with the instructions to proceed with the return of the relative product (s).
In compliance with the provisions of article 59, lett. c) and d) of the Consumer Code, the Consumer Customer cannot exercise the right of withdrawal for altered products due to lack of care by the Customer or in some way tampered with (plants already planted and subsequently grubbed up).
The transport costs for the return of the products are charged to the Customer, as foreseen by article 57, paragraph 1, of the Consumer Code.
Roseland will reimburse the price paid by the Consumer Customer within 14 days of receiving the returned products and after verifying the status of the same, using the same payment method used by the Consumer Customer at the time of purchase. The crediting times for the amount paid will be those applied by the payment circuit used by the Customer when ordering the product.
Applicable rules of law and jurisdiction
These General Conditions of Sale and the Contract are governed by Italian law, without prejudice to the provisions of the 1980 Vienna Convention.
Any dispute arising out of the application of these Conditions or the Contract shall be subject to the jurisdiction of the Italian court, as provided by the applicable Italian legislation.
